1. Accepting these terms
By using Gumbalup (“the Service”) you agree to these terms. If you don't agree, don't use it. These terms cover everyone: hosts, participants, and organization admins.
2. Accounts
Creating quizzes and hosting sessions requires an account with accurate information. You're responsible for your credentials and for what happens under your account. Players can join a session without an account.
3. Subscriptions & billing
Gumbalup has free and paid plans. Paid plans bill monthly or annually. You can upgrade, downgrade, or cancel at any time. Upgrades apply immediately with a prorated charge. Downgrades kick in at the end of the current billing cycle. We refund within 14 days of initial purchase if you're unhappy.
4. Acceptable use
You agree not to use the Service to:
- Create content that is illegal, harmful, or violates others' rights.
- Distribute malware or attempt unauthorized access.
- Impersonate a person or organization.
- Interfere with or disrupt the platform.
- Scrape or extract data using automated tools.
- Resell or redistribute the Service without authorization.
5. Your content
You own the quizzes, questions, and materials you create. By using the Service you grant us a limited license to host, display, and distribute that content for the sole purpose of running the Service. AI-generated quiz content is yours the moment it's generated.
6. Availability
We work hard to stay up but don't guarantee uninterrupted access. We schedule maintenance with notice. Features may change or be deprecated with reasonable notice. Paid plans target 99.9% uptime.
7. Limitation of liability
To the maximum extent the law allows, Gumbalup isn't liable for indirect, incidental, special, consequential, or punitive damages from your use of the Service. Our total liability for any claim related to these terms won't exceed the amount you paid us in the 12 months before the claim.
8. Organizations
Org admins manage member access and roles. Each organization's data is isolated from every other. Admins assign host and participant roles. Removing a member doesn't delete their past quiz participation data.
9. Termination
We may suspend or terminate an account that violates these terms. You can delete your account anytime. After termination your right to use the Service ends. We retain account data for 30 days after termination, then delete it.
10. Changes to these terms
We may update these terms. Material changes come with notice: email or in-app. Continuing to use Gumbalup after a change means you accept the new terms.
